1. About these terms
These terms and conditions (“Terms”) govern your use of the website of Cousins Steel International (Pty) Ltd (“CSI”, “we”, “us”), a structural steel design, fabrication and erection company registered in South Africa and based in KwaZulu-Natal.
By accessing or using this website you accept these Terms. If you do not agree with them, please stop using the site. These Terms do not replace a signed written agreement between you and CSI; where a signed contract exists, that contract prevails.
2. Use of the website
You may use this website for lawful purposes only. You may browse, view and print content for your own personal or internal business use, provided you keep all copyright and other notices intact.
You may not copy, reproduce, republish, scrape or distribute content from this website for commercial purposes without our prior written permission, and you may not use the site in any way that damages, overloads or impairs it or interferes with anyone else's use of it.
3. Quotations and estimates
Prices, rates and estimates shown or communicated by CSI are indicative and valid for 30 days from the date of issue unless stated otherwise in writing. They exclude VAT and any allowances (cranes, scaffolding, civils, electrical, permits, site preparation) unless expressly listed.
A quotation is based on the information available to us at the time it is prepared. Where drawings, site conditions or the scope differ from what we were told, we reserve the right to revise the price and the programme, and we will tell you before incurring the additional cost.
No work commences until a written order or signed contract is in place. Quotes are not offers capable of acceptance in a way that binds CSI to the stated price beyond the validity period above.
4. Orders, variations and programme
An order becomes binding only when CSI confirms it in writing. Variations to scope, drawings, materials or access must be agreed and priced in writing before the additional work is carried out.
Programmes and completion dates are estimates. We will keep you informed of progress, but delays caused by factors outside our reasonable control — including client or third-party delays, permits, material availability, load-shedding, weather, strikes and supply-chain disruption — entitle CSI to a fair extension of time and do not make us liable for the delay.
5. Payment
Unless otherwise agreed in writing, invoices are payable within 14 days of date in South African Rand by EFT into the bank account stated on the invoice.
Where a project is large or long-running, we may invoice in stages against agreed milestones and may require a deposit before fabrication begins. Late payments may attract interest at the maximum rate permitted by the National Credit Act, and we may suspend work or withhold delivery until accounts are brought up to date.
Title in fabricated steel passes to you only once payment in full has been received. Risk in the material passes on delivery or erection, as applicable.
6. Site access, health and safety
You are responsible for giving CSI safe, lawful and timely access to the site, for obtaining the permits and permissions needed for the works, and for disclosing hazards, services and ground conditions known to you.
CSI and its personnel comply with the Occupational Health and Safety Act and our safety procedures. We may stop work where conditions are unsafe until the issue is resolved, without that constituting a breach by CSI.
7. Warranty
CSI warrants its workmanship for 12 months from completion or practical handover, whichever comes first, provided the work has not been altered, damaged or used other than as intended. Defects arising from faulty workmanship within this period are repaired or rectified by CSI at our own cost.
This warranty does not cover normal wear and tear, damage caused by others, movement or settlement of the structure, misuse, lack of maintenance, or the performance of designs or materials supplied or specified by you or by a third party.
The warranty stated in this clause is in addition to and does not limit any rights you may have under South African law, including the Consumer Protection Act, 2008 where it applies.
8. Limitation of liability
CSI is not liable for indirect or consequential loss, loss of profit, loss of production, loss of contract or loss of anticipated savings, save where such loss arises from our gross negligence or wilful misconduct.
To the maximum extent permitted by law, CSI's total liability in connection with any project is limited to the value of the contract for that project. Nothing in these Terms excludes liability for death or personal injury caused by our negligence, or for fraud.
9. Intellectual property
All content on this website — text, logos, the CSI brand, photographs and graphics — belongs to CSI or its licensors and is protected by South African copyright law. The CSI logo and brand may not be used without our written permission.
Drawings, details and engineering calculations prepared by CSI remain our property and are supplied for the specific project they were prepared for. They may not be reused, issued to others or used for another project without our written consent.
10. Third-party links and content
This website contains links to third-party sites, including our social media pages and industry bodies such as SAISC, CIDB and SAICE. We are not responsible for the content, accuracy or practices of those sites and a link does not imply endorsement.
Project photographs show completed and in-progress work. Some images are of sites owned or controlled by third parties and are shown for portfolio purposes with the relevant permissions we hold.
11. Personal information
We handle personal information in accordance with the Protection of Personal Information Act, 2013 (POPIA). Details of what we collect and how we use it are set out in our Privacy Policy, which forms part of these Terms.
12. Changes to these terms
We may update these Terms from time to time to reflect changes to our services or to the law. The version published on this page is the one in force, so please review it when you next use the site. Continued use of the website after an update means you accept the revised Terms.
13. Governing law and disputes
These Terms are governed by the laws of the Republic of South Africa. The parties will first attempt in good faith to resolve any dispute arising under them directly, and failing that, the dispute will be settled in a competent South African court.
